2 Eligibility and authority

You must be at least eighteen (18) years old or the age of majority applicable in your jurisdiction, and legally capable of entering into the relevant binding contract. Where applicable law and the relevant product or service instructions permit use by a minor, that use must be with the consent and supervision of a parent or legal guardian who accepts the applicable Terms and assumes responsibility to the extent permitted by law. Hardware Products are not toys; age eligibility does not override product-specific safety restrictions. You must have legal capacity to place an order.

If you access or use the Products and Services on behalf of a corporation, partnership, association or other legal entity, you represent that you have authority to bind that entity, and references to “you” include that entity. To the extent permitted by law and validly agreed, the entity and the person undertaking the relevant obligations are jointly and severally liable for breaches attributable to them. Nothing in this provision automatically makes an authorized employee a personal guarantor of the entity’s obligations.

Where an account is used through any Website, App or Digital Service, provide accurate information, keep credentials secure, take reasonable steps to prevent unauthorized access and promptly notify us of suspected unauthorized access. You are responsible for account activity to the extent permitted by applicable law. Do not interfere with a Website or Digital Service, introduce malicious code, impersonate others or infringe their rights. Website-specific rules appear in Section 5; lawful account or service restrictions are governed by Section 16.

Upon registration, you will receive or establish an account and password. You may request account deletion at any time through the available account settings, subject to the deletion process described in the applicable Privacy Policy and interface. If you cannot complete the process or encounter an issue, contact privacy@ecoflow.com. Account deletion and data retention or deletion are handled under the Privacy Policy and applicable law; they do not automatically extinguish outstanding orders or accrued rights.

You must comply with applicable laws and regulations in your jurisdiction, including privacy, data protection and product safety requirements, and use Products and Services only for permitted purposes and within the applicable documentation. You are responsible for the legality of your own use based on your location; this does not transfer EcoFlow’s own compliance obligations to you.

To access certain features of the Product, you may be required to download and install the EcoFlow mobile application and log in using your EcoFlow account credentials. The functionality of some Products may be limited or inaccessible without such use.

3 Accounts lawful use and user obligations

4 Sales terms

This section applies to a purchase from the EcoFlow seller through an EcoFlow-operated Website or App store or another sales channel that expressly incorporates these Terms. The generally applicable provisions of these Terms also apply where relevant. This section does not replace your sales contract with an independent retailer or distributor. Mandatory statutory and applicable manufacturer warranty rights remain available regardless of purchase channel.

4.1 Product information availability and pricing errors

We aim to describe products and services accurately, but images, specifications, compatibility, availability, and prices may vary by market and may change. Please check the product page, applicable local disclosures, and checkout details before ordering.

If a product or service is listed with an obvious and material pricing error, we may decline the affected order before it is accepted. If we discover the error after accepting the order, we may cancel the affected order where the error provides a legal basis for doing so. We will promptly notify you, explain the error, and refund any amount paid for the affected order. We will not charge you a higher price without your express agreement.

If we otherwise cannot fulfill an order at the confirmed terms, we will notify you and provide the remedies required by applicable law. Nothing in this section limits your statutory rights. Website content is informational and does not replace product instructions or safety notices.

The availability and functionality of Products and Services, features or accessories may vary by jurisdiction for legal, technical or commercial reasons. Check the relevant market disclosures and comply with the laws applicable to your use.

4.2 Orders and contract formation

An order is your offer to buy the selected products or services. An automated acknowledgment that we have received your order does not, by itself, constitute acceptance. We accept an order when we send an express acceptance or shipping confirmation, or otherwise commence fulfillment, unless mandatory local law provides an earlier point of contract formation. We may decline an order for legitimate reasons, such as unavailability, suspected fraud, an obvious pricing error, or an applicable legal restriction, and will refund amounts collected for items we do not supply. We may limit quantities reasonably intended for personal use or disclosed promotions. If we cancel or materially change an accepted order, your statutory remedies remain available.

4.3 Prices taxes and payment

Prices displayed on the Website may change without prior notice. The price shown at checkout when you place your order will be reflected in your order details, and subsequent price changes will apply only to later orders. The total price, currency, applicable taxes, delivery charges, and any other mandatory charges will be displayed at checkout as required by law. The confirmed price applies to an accepted order, subject to Section 4.1 regarding obvious and material pricing errors.

Payment methods and timing appear at checkout. Unless otherwise stated, payment authorization or payment may be required before we accept an order; authorizing or collecting payment does not, by itself, mean that we have accepted the order. You confirm that you are authorized to use the chosen payment method and that the payment information you provide is accurate. Payment may be processed by a third-party provider under its applicable terms. Any financing or installment arrangement is subject to the separately presented provider terms. If we decline or cancel an order, we will release the payment authorization or refund amounts collected for the affected order in accordance with applicable law.

4.4 Delivery risk and title

The available shipping locations, delivery options, estimated delivery times, and charges are shown at checkout or in the Shipping Policy. Any delivery dates or times provided are estimates only, unless expressly stated otherwise or required by applicable law. To the extent permitted by applicable law, we are not responsible for delays caused by events beyond our reasonable control, including delays attributable to carriers, customs clearance, severe weather, natural disasters, governmental actions, or other circumstances outside our reasonable control. If a delay materially affects your order, you may have cancellation or other rights under applicable law.

Risk of loss and title pass as specified by applicable law and any expressly disclosed local sales terms; nothing in these Terms shifts consumer risk earlier than permitted by applicable law.

4.5 Cancellation returns refunds and warranty

Your cancellation, withdrawal, return, and refund rights are described in the Return and Refund Policy, subject to any mandatory rights under applicable law.
Products may be covered by our Limited Warranty as described in the Warranty Policy. Any contractual limited warranty is in addition to, and does not exclude, restrict, or replace, any statutory warranty, guarantee, or remedy that cannot be excluded under applicable law.
These Terms do not replace product-specific safety instructions or any mandatory statutory guarantee or remedy. The exclusions and limitations in Sections 13, 14 and 7.5 are subject to this Section and Section 18.

5 Website use

This section applies to access to and use of a Website, including browsing an online store without placing an order. The generally applicable provisions of these Terms, including accounts, User Content, privacy, communications, third-party materials and intellectual property, apply where relevant. If you place an order, Section 4 also applies; use of a linked App or connected feature may additionally be governed by Section 7.

5.1 Permitted use and access restrictions

You may use a Website for lawful personal or business purposes consistent with these Terms. Do not interfere with its operation, introduce malicious code, impersonate another person, infringe others’ rights or scrape it in a manner that burdens or disrupts it. Account duties and permissible access restrictions are governed by Sections 3 and 16. 5.1 Permitted use and access restrictions

You may use a Website for lawful personal or business purposes consistent with these Terms. Do not interfere with its operation, introduce malicious code, impersonate another person, infringe others’ rights or scrape it in a manner that burdens or disrupts it. Account duties and permissible access restrictions are governed by Sections 3 and 16. Website content is informational and does not replace product instructions, safety notices or the confirmed terms of an accepted order.

5.2 Website availability and content

We take reasonable steps to maintain the Website, but availability may be interrupted by maintenance, security incidents, or events outside our reasonable control. To the maximum extent permitted by applicable law, we are not liable for losses caused solely by an event outside our reasonable control where we have complied with applicable obligations. We do not exclude or limit liability for fraud, willful misconduct, death or personal injury caused by negligence, statutory product liability, mandatory consumer guarantees, or any other liability or remedy that cannot lawfully be excluded or limited. Any additional limitations disclosed for a specific digital service apply only if enforceable under local law.

The common content, intellectual property, third-party material, communication, disclaimer and liability rules in Sections 9, 11, 12, 13 and 14 apply to Website use. A Website access restriction does not automatically cancel an accepted order, end a separate service contract or remove lawful use of a Hardware Product you own.

6 Hardware Product use

7 Apps software and connected services

This section applies to EcoFlow MS, Apps, PowerInsight, user and professional Web Portals, embedded software and firmware, and the relevant connected features. The generally applicable provisions of these Terms and, where relevant, Sections 5 and 6 also apply. An in-App purchase from EcoFlow is additionally governed by Section 4. Feature-specific requirements apply only to features available and used; separately negotiated professional or enterprise agreements retain the priority specified in Section 1.

7.1 Software license and use restrictions

7.1.1 License grant

EcoFlow MS and associated software and firmware are licensed, not sold. Subject to these Terms, EcoFlow grants you a limited, revocable, non-exclusive, non-transferable and non-sublicensable license to download, install and use EcoFlow MS on a device you own or control (“Device”), and to access, stream, download and use the relevant content and services through it in accordance with the documentation. The standard personal App license is for use on a single Device unless EcoFlow authorizes additional devices through the relevant account, documentation or service configuration. Authorized Web Portal, professional, enterprise or multi-device functionality may be used within its documented permissions. This license does not grant ownership of EcoFlow MS or additional rights in underlying content or services beyond those expressly granted.

The license also covers software and firmware embedded in Hardware Products and the associated App. The standard consumer license is for personal, non-commercial use in accordance with the documentation, except where EcoFlow expressly permits business, professional or other commercial use through product documentation, an applicable service configuration or a separate agreement. All rights not expressly granted are reserved. Software license limits do not, by themselves, remove ownership of the physical Hardware Product or prohibit a use or transfer protected by mandatory law.

7.1.2 Restrictions

Except as expressly permitted by applicable law, an applicable open-source license or EcoFlow’s authorization, you must not, and must not permit or authorize another person to:
1) copy EcoFlow MS, in whole or in part, except as explicitly authorized by these Terms;
2) modify, translate, adapt, or otherwise create derivative works or improvements of EcoFlow MS, whether or not such modifications are protectable under intellectual property laws;
3) reverse engineer, decompile, disassemble, decode, or otherwise attempt to access or derive the source code of EcoFlow MS or any portion thereof;
4) remove, delete, alter, or obscure any copyright, trademark, patent, or other proprietary rights notices or legends from EcoFlow MS, including any copies thereof;
5) rent, lease, lend, sell, sublicense, assign, distribute, publish, transfer, or otherwise make available EcoFlow MS or any of its features or functionalities to any third party, including by enabling network access that permits simultaneous use by multiple devices;
6) use any automated means, including but not limited to robots, spiders, crawlers, or similar tools, to access EcoFlow MS for any purpose, including monitoring or scraping its content;
7) use any manual process to monitor, reproduce, or extract material from EcoFlow MS for any purpose not expressly authorized under these Terms, without EcoFlow’s prior written consent;
8) frame, mirror, embed, or otherwise incorporate EcoFlow MS, in whole or in part, into any other website, application, or service;
9) use EcoFlow MS in any manner that could interfere with, disrupt, damage, or impair the normal operation of EcoFlow MS or the use thereof by other users; or
10) remove, bypass, disable, damage, or otherwise circumvent any digital rights management, encryption, security mechanisms, or other protective features incorporated into or operating in connection with EcoFlow MS.

These restrictions also prohibit attempting to derive the source code or underlying algorithms of embedded software; modifying, adapting, translating, creating derivative works of or tampering with Hardware Products or their software components in an unauthorized manner; bypassing security or access controls; and using Products and Services for illegal, harmful or unauthorized purposes. They do not override rights to repair, interoperability, reverse engineering or other activities that cannot lawfully be restricted.

7.2 Authorized troubleshooting power station and API support
At your prior request and authorization, and subject to appropriate account and device permissions, EcoFlow may perform the following support operations:

7.2.1 Equipment troubleshooting

EcoFlow may conduct equipment-related support operations including but not limited to log export, firmware or software upgrades, parameter modifications, alarm clearance, device discovery, addition, replacement, and renaming of equipment. Applicable devices include, without limitation, inverters, energy storage systems, communication modules, and optimizers.

7.2.2 Power station fault management
EcoFlow may provide operational support for power stations, including data correction or supplementation, creation of new power stations, modification of station names, adjustment of basic parameters (such as time zones and electricity pricing), updates to physical layout diagrams, diagnostic testing, license uploads, IV curve scanning and analysis, configuration of alarm rules, and definition of data subscription policies.

7.2.3 Account assistance and API management

In the event the user forgets or loses the account password, EcoFlow will assist in resetting it. If the user account is disabled, EcoFlow will provide reactivation support. Upon the user’s request, EcoFlow may assist with the creation of a new user account or role, and—where applicable—support the activation and debugging of API accounts, including login troubleshooting, data call testing, and the association of API accounts with specific power stations.
All such operations will be performed solely with your prior request and authorization. EcoFlow will make commercially reasonable efforts to provide the requested support, but does not guarantee issue resolution in all cases. Any personal data involved will be processed in accordance with our Privacy Policy and applicable laws. Support for non-EcoFlow components, where applicable, may be limited and is provided on a best-effort basis.

7.3 EcoFlow Assistant AI training and voice features

7.3.1 AI training data usage

 Content you send to the EcoFlow Assistant may be used for AI training to improve EcoFlow’s products and services, subject to the Privacy Policy, applicable legal requirements and any required separate consent or available preference controls. Before use as anonymized training data, EcoFlow will remove personally identifiable information, including names, addresses, contact information and other identifying details, and apply measures intended to ensure the resulting data cannot reasonably be traced back to you. Data that remains identifiable will continue to be treated as personal information and will not be described as anonymous merely because direct identifiers have been removed. Anonymized training data is used solely to improve our products and services. See the applicable Privacy Policy for further details.

7.3.2 Voice activation and wake word detection

Where available, voice interaction features may be provided by EcoFlow or third parties such as AISPEECH and Google. Collection occurs only after you actively enable the feature. When the microphone is on, it may remain in a passive listening or background monitoring state for timely wake-word detection. Voice input, including wake words and commands, is processed for real-time voice functionality and system responsiveness. For a feature configured as described in its applicable notice, voice data is not stored or transmitted unless a recognized wake word activates the feature. You can disable voice interaction by turning off the microphone through the device or App settings, which also deactivates voice wake-up.

AISPEECH may process voice input solely for wake-word recognition and its improvement as described in the applicable feature notice. For features configured as described in the applicable notice, voice data is processed upon wake-word detection and is not stored or used in a functional scenario outside that context. Any additional collection, retention or training use is described in the applicable Privacy Policy or feature notice and takes place only on a lawful basis, with your separate consent where required.

Google speech services may provide real-time speech-to-text and text-to-speech processing during active interactions. For features configured as described in the applicable notice, those services do not persistently retain or repurpose the data for unrelated purposes. AISPEECH, Google and other third-party providers may have their own applicable terms and privacy notices. See the EcoFlow Privacy Policy for provider roles and details. Details of the processing that applies to your model and enabled features are available in the applicable Privacy Policy and feature notice.

7.3.3 AI feature scope and limitations

Some Products and Services may include AI-powered conversational assistance, voice-command interpretation, local wake-word detection or other features expressly described for the relevant product. Depending on the feature and disclosed configuration, processing may occur locally on your Device or through cloud-based models and providers. No feature is promised for a model or region unless expressly offered. Privacy and data handling are governed by Sections 10, 7.3 and the applicable Privacy Policy.

AI systems generate outputs through statistical and algorithmic processes. Outputs may be inaccurate, incomplete, biased or fabricated and may be affected by input quality, background noise, connectivity or other environmental and technical factors. Voice features may activate unintentionally when sounds resemble a wake word. Manage the available microphone and feature settings to reduce unintended activation and check important outputs or interpreted commands before relying on them.

AI assistance is for reference and does not replace product manuals, safety instructions or qualified medical, legal, financial or technical advice. Do not rely on an AI output as the sole basis for a safety-critical decision or an instruction contrary to the applicable product documentation. EcoFlow does not guarantee absolute accuracy, responsiveness, reliability, suitability, non-infringement or a particular saving, efficiency or performance gain. Any disclaimer and limitation is subject to Sections 4.5, 13, 14 and 18 and, where relevant, 7.5 and does not exclude mandatory rights or EcoFlow’s own non-excludable obligations.

7.3.4 AI acceptable use technology and inputs

Use AI features lawfully and within their intended scope. Do not use them to infringe rights, impersonate or deceive others, create fraudulent or otherwise unlawful synthetic content, conduct unlawful surveillance, or facilitate harmful or prohibited activity. You must use AI features in accordance with applicable law and only for their intended purposes. You must not use them to infringe the rights of others, impersonate or deceive others, create fraudulent or otherwise unlawful content, conduct unlawful surveillance, or facilitate harmful or illegal activities.

EcoFlow and its licensors retain rights in their AI algorithms, models, voice-processing software and underlying technologies. The limited right to use an offered feature does not authorize extraction of model weights, source code or underlying logic, reverse engineering, decompilation or disassembly, except where mandatory law or an applicable license permits it.

You retain rights you hold in your inputs, including voice prompts. You authorize EcoFlow and its providers to process them as necessary to provide and debug the feature, and to improve it only as described in the Privacy Policy and supported by an applicable lawful basis. This authorization does not replace any separate consent required for AI training or other processing; subsection 7.3.1 continues to govern training use. Do not submit inputs you lack the right to provide. To report an AI output that may infringe rights or present a privacy or safety concern, contact support@ecoflow.com or, for privacy matters, privacy@ecoflow.com.

7.4 Updates connectivity and service availability

7.4.1 Software and firmware updates

EcoFlow may provide firmware or software upgrades, including over-the-air (OTA) updates, bug fixes, patches, other error corrections and new features, with related documentation (“Updates”), to maintain security, functionality and performance, resolve reliability issues or comply with applicable laws, regulations and standards. Updates may modify or remove features where permitted by law and the applicable contract, subject to any required notice, consent or remedy. EcoFlow will provide any Updates required under applicable law or an express service commitment.

Depending on your device settings, and when your device is connected to the internet: EcoFlow MS may automatically download and install all available Updates; or you may receive a notification or prompt to manually download and install the Updates.

Install available Updates promptly in accordance with the documentation and applicable notification. Failure to install necessary Updates may impair functionality, security or reliability. Updates form part of the relevant software or service and are subject to these Terms. Automatic or manually initiated Updates may be necessary for continued use of affected connected features, subject to applicable law.

In exceptional circumstances, EcoFlow may install critical Updates directly where legally permitted, including where reasonably necessary for safety, cybersecurity or compliance. If you refuse an Update or your Device has technical limitations that prevent installation, you are responsible, to the extent permitted by law, for impacts actually caused by that refusal or limitation. This does not exclude EcoFlow’s own fault, mandatory update obligations or statutory remedies, and any legally required notice, information or consent must still be provided or obtained.

7.4.2 Availability and changes to connected services

Cloud, connectivity and remote-access features are not guaranteed to operate continuously or without error. EcoFlow may modify, suspend or discontinue such services for legitimate operational, security, technical or legal reasons, subject to applicable contractual commitments, statutory update and conformity obligations, and required notice, consent or remedies. Immediate action without prior notice may be taken where reasonably necessary and legally permitted; in other cases, required notice will be provided.
You acknowledge that EcoFlow does not guarantee uninterrupted system availability or 100% data uptime.

7.5 Technical data calculations and projected results

Technical data displayed through EcoFlow MS may be updated to reflect ongoing verification and production changes. Discrepancies and errors may nevertheless occur.
EcoFlow makes no warranty or representation regarding the completeness or accuracy of any data provided. In particular, the values presented do not represent protected or guaranteed characteristics.
EcoFlow assumes no responsibility for the accuracy, completeness, correctness, or quality of any information, documentation, projected results, or revenue-related data made available through the system. Nor is EcoFlow liable for any errors or omissions in referenced or linked third-party materials.
To the extent permitted by law and subject to Section 14, EcoFlow is not liable for material or immaterial loss caused by reliance on inaccurate or incomplete informational outputs, including incorrect profit or self-consumption calculations, loss of profit, use or operational continuity, hardware damage, data loss, product defects or consequential damages to the extent such exclusion is lawful. These information-related exclusions do not exclude liability for willful misconduct, gross negligence, mandatory product conformity, product safety or other non-excludable liability. Describing technical values as informational does not negate an agreed specification or legally binding product representation.
You are solely responsible for verifying the accuracy and applicability of the results generated through EcoFlow MS and ensuring their suitability for your intended use.
Any profit or self-consumption information presented via EcoFlow MS is for reference only and may not be used as a basis for billing, settlements, or claims against utility companies.

8 Promotions rewards and resale

8.1 Promotions and resale

Promotions are subject to their disclosed terms, duration, eligibility, and available stock. Unless we expressly authorize otherwise, consumer offers are intended for end users and may be subject to reasonable purchase limits. No provision of these Terms prohibits a lawful resale or transfer where such a restriction would be unenforceable. You must comply with export control, sanctions, and other applicable laws when purchasing, using, transferring, or exporting products.

8.2 Rewards and eligibility

You may receive promotional credits, points, discount codes, coupons, cash rewards, gifts or other benefits through participation in EcoFlow promotional or loyalty activities or use of Products and Services (collectively, “Rewards”). Rewards are subject to the specific terms disclosed for the relevant activity, including eligibility, earning conditions, value, expiry, redemption limits, eligible products, geographic restrictions and any permitted combination with other offers. Not all Products and Services are eligible for Rewards.

Unless the disclosed activity terms provide otherwise or applicable law requires otherwise, promotional points, credits, discount codes and coupons may be used only toward eligible purchases on the designated EcoFlow Websites or Apps, have no cash-redemption value, and may not be sold, transferred or exchanged for cash. Cash rewards are paid and gifts are delivered in accordance with the relevant activity terms; the restriction on cash redemption does not convert an expressly promised cash reward into a discount.

8.3 Reward rules refunds and misuse

The terms of the relevant activity explain how cancellation, return or refund affects your Rewards, including whether Rewards earned from a refunded purchase are reversed and whether redeemed Rewards are restored. These rules do not reduce any mandatory cash refund or other statutory remedy. EcoFlow may withhold, reverse or cancel Rewards reasonably attributable to fraud, duplicate claims, misuse or an unfulfilled eligibility condition, subject to applicable law and any required notice or opportunity to contest the decision.

For the specific Reward concerned, properly disclosed activity terms prevail over an inconsistent general Reward provision, subject to mandatory law. Material restrictions are set out in the activity terms made available before you participate or obtain a Reward. Changes do not retroactively deprive you of an accrued benefit contrary to the agreed terms or applicable law. Purchased gift cards, prepaid value and amounts owed as refunds are governed by their separately disclosed terms and applicable law, and are not treated as ordinary promotional Rewards merely because they are recorded as an account credit.

10 Data processing privacy and user choices

The applicable EcoFlow Privacy Policy explains how personal information is collected, used, shared and retained and how to exercise applicable rights. Review it before providing information through a Website, App or connected product. All personal data processing is subject to that Policy and applicable law.

When you download, install, access or use EcoFlow MS or a Website, EcoFlow may collect information about your Device and usage, including through cookies and web beacons where permitted by law. Certain features may require personal information. Any required consent for non-essential cookies, tracking or other processing will be obtained through the applicable interface.

Hardware Products and associated software features, including voice interactions where available, may generate or process technical and personal data as described below and in the Privacy Policy:
(a) EcoFlow may collect data such as device identifiers, firmware version, hardware configuration, energy usage patterns, interaction logs, and diagnostic metrics;
(b) Where your Product is linked to an EcoFlow account or mobile application, we may collect information including account credentials, usage history, geolocation data (if enabled), and system performance logs;
(c) Such data may be used for purposes including but not limited to:
(i) delivering technical support and product updates;
(ii) optimizing device performance and user experience;
(iii) ensuring product safety and compliance with regulatory requirements;
(iv) detecting abnormal use, fraud, or abuse.
All data processing activities are conducted in accordance with the EcoFlow Privacy Policy and applicable laws, including but not limited to the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), and other regional data protection statutes. Where required by law, EcoFlow will obtain separate or explicit consent before processing data that is not essential to the core functionality of the Product.

You may manage data preferences and disable non-essential features, such as voice assistants, through the App or device settings. Acceptance of these Terms or continued use acknowledges the relevant privacy disclosures but does not, by itself, constitute consent where applicable law requires a separate, specific or affirmative choice. Processing may rely on consent or another lawful basis as explained in the Privacy Policy. Withdrawal and other privacy rights remain available as provided by law.

11 Third party materials services and links

EcoFlow MS may display, incorporate, or otherwise make available content, data, applications, services, and other materials originating from third parties (collectively, “Third-Party Materials”), including through embedded links or third-party advertising. Third-Party Materials may also include access to third-party websites or platforms.

The Website may link to third-party websites or offer services delivered by third parties, including payment or financing providers. Their own terms and privacy notices may apply. We do not control third-party sites, but nothing in this section limits responsibility that applicable law places on EcoFlow for its own products, services, or chosen providers.

Third-Party Materials may be provided solely for convenience and are subject to the applicable third-party terms, conditions and privacy notices. EcoFlow does not control or endorse independent Third-Party Materials and, to the extent permitted by law, does not warrant their accuracy, completeness, timeliness, validity, legality, decency, quality or compliance with intellectual property laws. Access or use is at your own risk to the extent permitted by law. These exclusions do not remove responsibility imposed on EcoFlow for its own conduct, Products and Services or chosen providers, or any other non-excludable obligation.

12 Service communications and marketing text messages

12.1 Electronic service communications

We may use the contact details you provide to send order confirmations, account and service updates, support responses, safety notices and other communications relating to the Products and Services you request, as permitted by applicable law.

If you register an account or otherwise provide your email address, we may also send you marketing emails about EcoFlow products, services and promotions where applicable law permits us to do so without prior consent, unless you have opted out. Where applicable law requires your prior consent, we will obtain that consent before sending marketing communications. You may unsubscribe from marketing emails at any time using the unsubscribe link included in each email.

Marketing text messages and calls are subject to the consent requirements applicable to those channels. Accepting these Terms or providing a telephone number does not, by itself, constitute any separate consent required by applicable law. Unsubscribing from marketing does not prevent us from sending necessary service-related communications.

12.2 Marketing research and participation invitations

EcoFlow may send promotions and invitations to surveys, product research, community collaboration or beta testing only where supported by the consent or other legal basis required in your region. Where opt-in consent is required, EcoFlow will obtain it before sending those communications and identify the relevant sender and scope. Participation in research or testing may be subject to separately presented terms and privacy information. You may unsubscribe from marketing emails through the unsubscribe link in the message or another available method. EcoFlow will honor the request as required by law. Unsubscribing does not prevent necessary service or safety communications. Joining a later promotion or requesting a discount code does not automatically reinstate general marketing subscriptions; activity-specific messages remain subject to the applicable communication rules, and we will obtain any renewed marketing consent required by law.

12.3 Text messages

Where text messaging is offered and you separately opt in: By submitting a phone number through a Website, App or other designated opt-in interface and opting in to receive text messages, you consent to receive informational and/or marketing text messages from EcoFlow at the telephone number provided, including messages sent using automated technology or an automatic dialing system. Message and data rates may apply. Message frequency varies. For help, text HELP to the sender. You can unsubscribe at any time by replying STOP to the sender or by another method described in the message or applicable law. Consent is not a condition of purchasing any goods or services. We will honor withdrawal requests as required by applicable law. This paragraph applies only to messaging programs available in your region; the sender, messaging program and applicable additional local terms are identified in the opt-in form and messages.

13 Common disclaimers

To the fullest extent permitted by applicable law, the Website and any digital services are provided on an “as is” and “as available” basis. EcoFlow does not warrant that the Website or digital services will be uninterrupted, error-free, secure, or free from harmful components, or that all information made available through them will always be accurate, complete, or current.

EXCEPT FOR EXPRESS WARRANTIES IN THE APPLICABLE WARRANTY POLICY OR CONTRACT AND ALL WARRANTIES, GUARANTEES, CONDITIONS AND RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED, PRODUCTS AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS TO THE EXTENT PERMITTED BY LAW. EcoFlow disclaims other express or implied warranties, representations and conditions, including merchantability, fitness for a particular purpose, title, quiet enjoyment, non-infringement and accuracy, and those arising from a course of dealing, course of performance or usage in trade, only to the extent such exclusion is lawful.

To that same extent, EcoFlow does not warrant that Products and Services, accessories, content or materials will be uninterrupted, error-free, secure or free from viruses or harmful components, or that every identified defect will be corrected. This does not limit a legally required repair, correction or other remedy. No oral or written advice or information creates an additional warranty unless legally binding or expressly agreed; mandatory rights and actionable representations are unaffected.

You are responsible for risks and consequences attributable to your own use, including misuse, of Products and Services, to the extent permitted by law. Such consequences may include personal injury, death, damage to your computer, mobile device or EcoFlow hardware, third-party property damage, or data loss. This provision does not make you responsible for a product defect, EcoFlow’s own fault or a liability that law places on EcoFlow.

Nothing in these Terms excludes or limits any warranty, guarantee, condition or other right that cannot lawfully be excluded or limited. Product warranties and statutory consumer rights are addressed in Section 4.5, Section 18 and the applicable Warranty Policy.

14 Limitation of liability and indemnification

14.1 Non excludable liability

These limitations do not apply to liability that cannot lawfully be excluded or limited, including where applicable liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, willful misconduct, gross negligence, or mandatory consumer rights.

Some jurisdictions do not allow the exclusion or limitation of certain types of liability. In such cases, the above limitations may not apply to you, and you may have additional rights under local laws.

All disclaimers, limitations, risk allocations and indemnities in these Terms are subject to this subsection, Section 4.5, Section 18 and mandatory applicable law. Nothing limits statutory product liability or another non-excludable remedy. Personal injury and property damage are not automatically classified as indirect losses.

14.2 Excluded losses

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EcoFlow, its affiliates, officers, directors, employees, agents, licensors and service providers will not be liable for indirect, incidental, special, exemplary, punitive or consequential damages arising from these Terms or the use of, or inability to use, the Website or Products and Services, including loss of profits, revenue, business, data, goodwill, anticipated savings, operational continuity or use; costs of substitute goods or services; business interruption; or computer failure or malfunction. Claims involving personal injury, death or property damage remain subject to subsection 14.1 and may be limited only where the particular limitation is lawful.

The above limitations apply regardless of the legal theory on which the claim is based, whether arising in contract, tort (including negligence), or otherwise, and even if EcoFlow was advised of the possibility of such damages or such damages were foreseeable.

14.3 Aggregate monetary limits

To the fullest extent permitted by applicable law, EcoFlow’s aggregate liability arising from a Hardware Product, sale or other transaction will not exceed the amount you actually paid for the relevant product or service giving rise to the claim. For a claim arising solely from an independently supplied EcoFlow MS or Digital Service, the corresponding limit is the total amount actually paid for that system or service. The standalone service limit does not reduce the limit applicable to a claim concerning a purchased Hardware Product or bundled service, and does not cap any liability or remedy protected by subsection 14.1.

To the extent a data-loss limitation is lawful, liability for restoring lost data is limited to the standard cost of restoring it from regular backups. This does not apply to loss caused by EcoFlow’s intent, willful misconduct or gross negligence, or to non-excludable privacy, data protection or other liabilities. It is subject to the applicable limits and exceptions above.

14.4 Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend and hold harmless EcoFlow and its directors, officers, employees, agents, contractors and affiliates against third-party claims, damages, losses, liabilities, costs and expenses, including reasonable attorneys’ fees, arising from: (a) your access to or use of Products and Services where responsibility is legally attributable to you; (b) your breach of these Terms or violation of applicable law; or (c) your infringement of third-party rights, including intellectual property rights. This obligation does not cover EcoFlow’s own fault, a product defect or an obligation that cannot lawfully be shifted to you, and does not require indemnification merely because you exercise statutory consumer rights.

EcoFlow reserves the right to assume the exclusive defense and control of any matter subject to indemnification hereunder.

Any control of a defense is subject to applicable law and your legitimate interests; no settlement may impose an admission or additional obligation on you without any consent required by law.

15 Export controls sanctions and trade compliance

You must comply with applicable export control, sanctions, and trade laws and regulations in connection with your use, purchase, transfer, export, re-export, resale, or other disposition of the products, software, technology, and services.

Products and Services may be subject to export control, customs, sanctions and other trade laws, including applicable laws of the United States, the European Union, the United Nations as implemented by relevant jurisdictions, and other relevant jurisdictions. These may include the U.S. Export Administration Regulations, restrictions involving the U.S. Treasury Specially Designated Nationals (SDN) List and U.S. Commerce Entity List, and other applicable restricted-party lists. You must not export, re-export, transfer, sell, otherwise make available or use a Product, software, technology or service in violation of an applicable restriction, including a restriction concerning a destination, person, entity, end user or end use, nuclear, chemical or biological weapons proliferation, or a prohibited military end use.

You represent that your location, residence, nationality, restricted-party status and any person on whose behalf you act do not make the relevant transaction or use prohibited under the laws actually applicable to it. Restricted territories and parties are determined under applicable law at the time of the transaction or use; a reference to a restricted-party list does not imply that every listing imposes the same type of restriction.

EcoFlow may refuse, suspend or cancel a transaction or service, or suspend or terminate access to EcoFlow MS or other Digital Services, where reasonably necessary to comply with applicable trade restrictions or address a violation of this Section. Immediate action without prior notice may be taken where legally required or permitted; applicable notice, refund and other mandatory obligations remain effective.

16 Term suspension and termination

The term of these Terms begins upon your acceptance and shall remain in effect until terminated by either you or EcoFlow in accordance with this Section.

You may stop using a Website or Digital Service at any time. You may terminate your use of EcoFlow MS by deleting it and all associated copies from your Device and discontinuing access; account deletion is handled under Section 3. Ending use of a service does not, by itself, cancel an accepted order or eliminate accrued obligations.

Subject to applicable law, EcoFlow may suspend or terminate your access to a Website, account, EcoFlow MS or other Digital Services if: (a) you materially breach these Terms; (b) law or a competent authority requires it; (c) your actions create a security, safety or legal risk or possible legal exposure for EcoFlow or others; or (d) there are reasonable grounds to suspect fraudulent, abusive or unlawful activity. Any restriction will be proportionate to the affected service and the circumstances giving rise to it.

EcoFlow may also discontinue support for EcoFlow MS or a connected service where permitted under applicable law and its contractual commitments. Immediate suspension or termination without prior notice, including termination of the affected license following a material breach, may occur where legally permitted and reasonably necessary. Otherwise, EcoFlow will provide any legally required notice and opportunity to remedy the breach; discontinuance remains subject to required update, conformity and consumer remedies.

Upon termination of an affected software license, the corresponding license rights cease and you must discontinue access and permanently delete the affected software copies from your Device and account, where technically possible and legally required. Termination does not affect accrued rights, remedies or obligations of either party. It does not automatically require you to stop all lawful use of a Hardware Product you own, transfer its title back to EcoFlow, or forfeit warranty, refund or other statutory rights.

Provisions that by their nature survive termination continue to apply, including applicable privacy and data handling, feedback and intellectual property rights, indemnification, trade compliance, disclaimers, liability limitations, dispute resolution and accrued payment or transaction obligations. Survival is subject to mandatory law and does not extend a processing authorization beyond its lawful scope.

17 Changes to these Terms

EcoFlow may amend or update these Terms by posting the revised version and effective date through official channels, including the relevant Website or App. Subject to any legally required notice or renewed acceptance, continued use after the effective date constitutes acceptance only to the extent legally effective. If a material change requires express consent, continued use alone does not substitute for it.

We may update these Terms by posting a revised version and effective date. Changes apply prospectively to Website use after they take effect and, for new purchases, to orders placed after they take effect. They do not retroactively change an accepted order unless you expressly agree or applicable law permits. If law requires advance notice or renewed consent, we will provide it. Changes to these Terms will apply to ongoing Products and Services in accordance with the applicable contract and law, including any required notice, consent or right to terminate.

18 Governing law disputes and regional protections

18.1 General law and dispute provisions

The governing law and any permitted court arrangements for the relevant region and service are stated in Appendix 1. A choice of law does not deprive a consumer of mandatory protections of the law of the consumer’s habitual residence where applicable. A consumer may bring or defend proceedings in any court available under applicable consumer jurisdiction rules. Where permitted by law and validly agreed, a dispute may also be brought in the courts identified in Appendix 1. You may contact support@ecoflow.com or the applicable regional support channel to seek a resolution before filing, but this is not a mandatory precondition to exercising statutory rights.

To the fullest extent permitted by applicable law, you and EcoFlow agree that disputes arising out of or relating to these Terms, including Website use and purchases, will be resolved on an individual basis. Neither party may bring or participate in a class, collective or representative action, or consolidate claims with those of another person. This restriction does not apply to any right or proceeding that cannot lawfully be waived, including any non-waivable right to seek public injunctive relief. If this restriction is unenforceable, the remaining provisions of this subsection continue to apply to the extent permitted by law.

18.2 EU and EEA users

Nothing in these Terms shall exclude or limit rights under applicable EU consumer law, including statutory guarantees of conformity. Liability for death, personal injury, or fraudulent misrepresentation shall not be excluded or limited.

18.3 Australian users

If you are a resident of Australia, our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (“ACL”). Under the ACL, you are entitled to a replacement or refund in the event of a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods or services repaired or replaced if they fail to meet acceptable quality standards and the failure does not amount to a major failure.

Applicable statutory guarantees include acceptable quality and fitness for a disclosed purpose for goods, and due care and skill, fitness for a disclosed purpose or agreed result, and supply within a reasonable time where no time is agreed for services. You retain the protections provided by these guarantees, including EcoFlow’s obligation to exercise the care required by law to avoid loss or damage. Product and service guarantees apply according to the Australian Consumer Law; they are not limited to the contractual Warranty Policy.

To make a claim, contact support@ecoflow.com or the regional support channel. If assessment establishes that the claim is not covered by a statutory guarantee or other remedy, EcoFlow may seek reasonable assessment or processing costs only where lawful and where any required disclosure and agreement have occurred. You will not be charged for exercising a valid statutory remedy contrary to law.

18.4 United States users and other local rights

Some states do not allow exclusion of certain warranties or limitation of certain liabilities. To the extent that such exclusions or limitations are not enforceable under applicable law, they may not apply to you.

20 General terms

Neither party is liable for a delay or failure to perform an obligation under these Terms to the extent caused by circumstances beyond its reasonable control, including acts of God; natural disasters, severe weather, fire or flood; epidemic or pandemic; war, terrorism or civil unrest; labor disputes or strikes; shortages; interruption of transportation, power or other utilities; Internet, telecommunications or infrastructure failures; cyberattacks; governmental actions or changes in applicable laws, regulations or orders, including tariffs, customs measures, sanctions, embargoes and import or export restrictions, to the extent they prevent or materially impede performance; or third-party service-provider or supplier failures that themselves fall beyond the affected party’s reasonable control and responsibility.

Affected obligations may be suspended only to the extent and for the duration reasonably affected by the event, subject to applicable law and reasonable mitigation. A foreseeable or avoidable failure is not automatically excused merely because it involves a third party.

This provision does not excuse payment obligations already due and does not limit any cancellation, refund, statutory consumer, or other rights that cannot be excluded under applicable law.

19 Force majeure

20.1 Assignment

You may not assign or transfer your account or your rights or obligations under these Terms without our prior consent, except where applicable law permits. EcoFlow may assign or transfer its rights or obligations under these Terms, provided that doing so does not reduce your mandatory rights and any notice or consent required by applicable law is provided or obtained.

These restrictions also cover delegation and sublicensing of a software license. An unauthorized transfer is ineffective to the extent permitted by law. EcoFlow may transfer its rights and obligations within the limits above; this does not authorize a reduction of mandatory rights. Assignment restrictions do not prohibit lawful transfer or resale of a physical Hardware Product.

20.2 Severability

If a provision is invalid, illegal or unenforceable, it may be modified, limited or severed only to the extent legally permitted and necessary; the remaining provisions continue in force to the extent lawful. Nothing requires a court or authority to rewrite an unfair consumer term where applicable law does not permit that approach.

20.3 No waiver

A failure or delay by either party to exercise or enforce any right or provision under these Terms does not constitute a waiver of that right or provision. A single or partial exercise of a right does not preclude another or further exercise of that or another right or remedy.

20.4 Entire agreement and written amendments

These Terms, together with the details accepted at checkout and any policies, supplemental terms, or product- or service-specific terms expressly incorporated by reference, constitute the agreement between you and EcoFlow concerning the relevant use, product, service, or transaction and supersede prior agreements, communications, or understandings concerning the same subject matter, except where applicable law provides otherwise.

A separately negotiated amendment must be in writing and signed by an authorized EcoFlow representative and any other party whose agreement is required. This does not prevent valid updates made under Section 17 or a legally effective electronic agreement. The entire-agreement provision does not exclude mandatory rights, actionable representations or commitments that law requires to remain effective.

20.5 Headings and language

 Section headings are for convenience only and do not affect the interpretation of these Terms. These Terms may be made available in multiple languages. Where applicable law requires a particular language version to prevail, that requirement will apply. Otherwise, the controlling version will be the version expressly identified as controlling at the time you agree to these Terms.

20.6 Lawful interpretation and risk allocation

The exclusions, limitations and allocation of responsibility in these Terms are intended to apply only within lawful and reasonable bounds in the relevant circumstances. Acceptance or use of a service does not establish that an otherwise unlawful or unfair provision is enforceable, and does not waive a mandatory right. Any restriction in these Terms is subject to the applicable regional protections.

Appendix 1 Regional entities law and courts

Nothing in this appendix limits your mandatory consumer rights, statutory warranties or remedies, or access to courts available under applicable law. An omission or error in this appendix does not change the seller disclosed for your purchase at checkout or limit the protections of applicable law.

Use the relevant regional entry for the transaction or service concerned. A seller, Website operator, Digital Services provider and privacy controller may be different entities. The applicable Privacy Policy identifies the controller; identifying a controller or data holder does not, by itself, identify the contractual seller.
